Zona Restringida -- Restricted Zone for Foreign Direct Ownership
RestrictiveThe Mexican Constitution (Article 27) prohibits direct foreign ownership of real estate within 100km of any international border or 50km of any coastline. This 'Zona Restringida' includes virtually all popular beach destinations (Cancun, Playa, Tulum, Puerto Vallarta, Los Cabos, Sayulita). Two compliant workarounds: (1) Fideicomiso bank trust for residential, (2) Mexican corporation for commercial property.
- Restricted Zone: 100km from borders + 50km from coastlines
- Foreign individuals CANNOT directly own freehold in Restricted Zone
- Workaround #1: Fideicomiso (bank trust) -- 50-year renewable, foreign beneficiary holds full economic rights
- Workaround #2: Mexican corporation (typically for commercial / multiple residential properties)
- Outside Restricted Zone (inland cities): full freehold rights for foreigners
